License Terms
The license granted to use the Viktor service, and its restrictions.

These License Terms form part of, and are incorporated by reference into, the Viktor General Terms of Service. Capitalized terms used but not defined herein have the meanings given in the Definitions.
1. License Grant
Subject to this Agreement and the payment of applicable fees, Provider grants Customer a non-exclusive, non-transferable, non-sublicensable, revocable right during the Subscription Term to access and use the Service solely for Customer’s internal business purposes, in accordance with the Documentation and the applicable Order Form if applicable.
2. License Metrics
The license is subject to any usage limits, seat limits, or other metrics specified in the Order Form (“License Metrics”).
3. Outsourcing
Customer may permit its outsourcing service providers to access the Service solely for Customer’s own business purposes, provided that Customer remains responsible for their acts and omissions and ensures their compliance with this Agreement.
4. Restrictions
Customer shall not, and shall not permit any third party to:
(a) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying models of the Service, except to the extent applicable law expressly permits;
(b) modify, translate, or create derivative works of the Service;
(c) sublicense, resell, lease, lend, distribute, or otherwise commercially exploit the Service;
(d) remove or alter proprietary notices;
(e) use the Service to develop a competing product; or
(f) circumvent rate limits, technical protection measures, or access controls.
5. Third-Party Rights Removal
If Provider is notified by a third party or rights holder that Customer Data uploaded to the Service infringes its rights, Provider may investigate and, in good faith and reasonable discretion, determine whether such data should be removed. Removal may occur
(a) where required by law, or
(b) where Provider reasonably determines removal is necessary to protect the third party against continued infringement (and Provider against liability) and cannot be prevented by suspension with reasonable prior notice.
Such removal does not give rise to any refund or damages claim against Provider.
6. Beta and Preview Features
Provider may from time to time make features, functionality, or services available on an experimental, beta, preview, or “early access” basis (collectively, “Beta Features”). Beta Features:
(a) are provided “as is” and “as available,” without warranty of any kind;
(b) are not subject to support obligations, or any service-level commitments;
(c) may be modified, suspended, withdrawn, or made unavailable at any time, with or without notice, in Provider’s sole discretion;
(d) may have additional terms of use that Customer must accept before using them; and
(e) may collect additional usage telemetry to support Provider’s evaluation and improvement of the Beta Feature. Customer’s use of Beta Features is voluntary and entirely at Customer’s own risk.
7. New Versions
Provider may from time to time, in its discretion, release updates, patches, new versions, or replacement components for the Service. Customer has no right to demand specific features or to refuse updates. Provider may modify, replace, or discontinue specific features, integrations, AI models, or capabilities at any time. Modifications to specific features do not constitute a discontinuation of the Core Service. Provider shall provide reasonable advance notice (where practicable) of changes that materially and adversely affect Customer’s use of the Service. Updates may require Customer’s systems to meet revised technical requirements, which Provider shall communicate in advance. Order Form may designate specific features or integrations as “Critical Functionalities” for that Customer; if Provider permanently discontinues a Critical Functionality so designated and does not provide a substantially equivalent replacement within a reasonable cure period, Customer may terminate the affected portion of the Service with a pro-rata refund of any prepaid fees for the unused portion of the then-current Subscription Term, excluding Credits already consumed and non-refundable Credit purchases, unless otherwise required by applicable law.
